A NOVEMBER 30, 2009 DISTRIBUTION IS THE TARGET!

        The trustee is striving to notice this case to all creditors within 60 days. The case is under final review at this time. A hearing on the distribution to all approved priority creditors has been set for November 13, 2009 at 9 a.m.  Once an order to distribute is received from the court, the 6,310 checks will be mailed within two weeks of the order.

    A copy of the notice as well as the list of all creditors who can expect to receive payment can be viewed on the links below.

    The trustee expects to pay the allowed priority ticket claims approximately 30% on the dollar and then close the case.

Creditors, please note the following:

1. Creditors who are scheduled to receive a pro ration % portion of less than $5.00 will receive no distribution under local bankruptcy rules;

2. Creditors with no, incomplete or inaccurate address will have their funds remitted to the clerk of the court under local rules;

3. Creditors will have only 90 days to cash their checks before the checks become stale;

4. All creditors with a higher priority Chapter 11 administrative vendor, ticket and wage claim have been paid in full or checks remitted to the court for incomplete address;

5. All priority wage claims (those on or before 4/14/95) and benefit claims have been paid in full or remitted to the court for incomplete address;

6. Checks will be mailed approximately 10-14 days after the scheduled hearing on November 13, 2009 at 9 a.m.
